These General Terms and Conditions of Use and Business for Switzerland (“GTCU”) govern the relationship between the customer and Axxios Technology SA. Axxios means Axxios Technology SA and is committed to providing its customers with quality products (anti-vibration system). Our priority is our customer satisfaction, with the aim of providing an excellent service and experience. By placing an order via the website, customers acknowledge that they have read and understood the GTC and accept them without reservation. If the customer does not agree with Axxios’ general terms and conditions, he or she shall refrain from placing an order via the website.

1. Scope of application and modification of the general terms and conditions

Axxios reserves the right to modify the GTC at any time and without prior notice by publishing a new version of the GTC (which cancels and replaces the existing version) on the website. Any order placed after Axxios has published a new version of the GTCs shall be deemed to constitute acceptance of this new version. Axxios’ entire offer is intended for customers in Switzerland and the Principality of Liechtenstein. Axxios accepts no liability for any errors or inaccuracies in all publications, including this homepage.

2. Registration

The customer is solely responsible for the accuracy and completeness of the information he or she provides when registering on the site. The customer must inform Axxios of any change in the data by updating his customer profile without delay.

3. Order procedure

Only customers who are of legal age, capable of discernment and not under guardianship are authorised to place orders via the website. By placing the order, the customer undertakes and declares to make a firm and definitive offer to Axxios to purchase the goods selected under the conditions indicated on the website. The formal submission of the offer by the customer takes place with the confirmation of the order.

4. Prices

Axxios reserves the right to modify the prices at any time. Only the price indicated in the order confirmation is valid. The prices indicated on the site are in Swiss francs (CHF) and normally include VAT. Shipping costs may be charged in addition, as indicated in the order confirmation. The prices shown on the website are only valid in Switzerland and the Principality of Liechtenstein.

5. Methods of payment

Only the payment methods indicated by Axxios on the website are accepted. For each order offer, a prepayment of the total amount of the order as well as shipping costs (if applicable) must be made.

6. Delivery

For delivery, the costs indicated in the order confirmation will be charged. The products will be sent to the delivery address indicated by the customer when ordering. The customer is solely responsible for the accuracy and currency of the address provided to Axxios. Axxios cannot therefore be held responsible if a product is delivered incorrectly due to an incorrect or outdated address. Axxios will make every effort to ship the products ordered within two working days following the end of the purchase process. However, this time limit is only indicative and is not contractual.

7. Assembly

Axxios declines all responsibility in the event of damage to a component if the material and the recommended procedure have not been followed.

8. Right of revocation

There is no right of withdrawal for customers. In principle, ordered products can neither be exchanged nor taken back. Exceptions are incorrect deliveries or deliveries with transport damage. We ask you to check the correctness and completeness of the delivery immediately upon receipt. Any transport damage must be reported to axxios@axxios-tech.com within two days of receipt. Subsequent complaints cannot be taken into account. The customer must bear the cost of returning the goods originally packed to Axxios.

9. Availability

If a desired product is no longer available, Axxios will contact the customer. Axxios is not obliged to deliver in case of unavailability.

10. Data protection

With regard to the collection and processing of personal data, Axxios is subject to Swiss data protection legislation. When an order is placed with Axxios, only the data required to process the order is recorded. Customer personal data will be treated confidentially in accordance with data protection legislation and will not be passed on to third parties, used for external advertising purposes or sold.

11. Responsibility

Axxios excludes all liability, regardless of its legal basis, as well as claims for damages against Axxios and any auxiliary person and vicarious agents. In particular, Axxios shall not be liable for indirect and consequential damages, loss of profit or other damages to persons, property and pure financial loss of customers. Any other mandatory legal liability, e.g. in cases of gross negligence or unlawful intent, remains reserved.

12. Other provisions

The place of jurisdiction is Delémont, unless the law provides for compulsory places of jurisdiction.
